IDENTITY OF THE SELLER

GENERAL PROVISIONS
These general conditions of sale (hereinafter, “GENERAL CONDITIONS”) are provided by the Company MOLINO IL FATTORE DI TEGA LUIGI & C. SASto its customers with a view to transparency and completeness and apply to all sales of products purchased through this website. The Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS may sometimes find itself in need of modifying some provisions of the General Conditions; we therefore invite customers to consult them before each visit to the site. The validation of an order implies the tacit reading and acceptance of the General Conditions present at that moment.
In compliance with the provisions of the Italian and EU laws currently in force, the economic relationship between the seller and the customer is governed by consumer protection legislation exclusively in the event that the customer purchases for personal purposes unrelated to his/her work activity. Therefore, the consumer protection regulations, including in particular the Legislative Decree, do not apply to the relationships between the seller and the professional who purchases for purposes inherent to their work activity, be it of an entrepreneurial or commercial nature, by providing their VAT number. n.185 of 1999 (contracts concluded remotely), Legislative Decree n.50 of 1992 (right of withdrawal) and articles. 1469 bis and following. d.c.
The contracts concluded with the Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS through the site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (hereinafter “CONSUMER CODE”) and by Legislative Decree 9 April 2003, n. 70 (hereinafter, “DECREE AND COMMERCE”).

PRICES AND PAYMENTS
There is no minimum order (for Italy) to purchase. Shipping costs consist of a fixed rate for various countries unless there is the possibility of free shipping after a certain monetary amount in the order. There may be additions to the transport price in case of request for particular services such as 24-hour delivery, call alerts, deliveries to depots and courier points, etc.

VAT: The price of the products is inclusive of all VAT taxes and duties. All prices are expressed in Euros.

Payment can be made with:

  • Credit card;
  • In advance by bank transfer;
  • Apple Pay
  • Google Pay

Persons obliged to request an invoice must request it at the time of ordering, communicating the VAT number. and/or tax code with unique code or PEC.

HOW TO EXECUTE ORDERS
Online orders can be placed according to the methods and terms indicated on the page.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained in the Site. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Privacy Policy Policy, you will need to enter your shipping and billing information, select the desired payment method and confirm the order.
With the confirmation of the order, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.
The contract stipulated with the Customer must be considered concluded with the acceptance of the order by the Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS. This acceptance is communicated to the Customer through an order confirmation email. If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by the failure to accept or fulfill, even partially, an order.

DELIVERY & SHIPMENTS
The Company MOLINO IL FATTORE DI TEGA LUIGI & C. SASdelivers directly to the address indicated by the Customers at the time of the order;
The ordered goods therefore travel completely at the risk of the Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS.
Depending on the destination area of the goods (Italy/Europe), deliveries may take place within a period of time ranging from 2 to 15 days, barring setbacks. All purchases will be delivered by express courier from Monday to Friday, excluding holidays and national holidays. After shipping the goods, a confirmation email with tracking number will be sent to the Customer, which will include a link to refer to for tracking the shipment.

For shipments to Italy, the conditions are as follows:

  • No minimum order
  • Fixed shipping rate: 10.00 euros
  • Free shipping over 300 euros (inclusive)

For non-Italian destinations the costs are as follows:

For shipments to Austria, France, Germany the conditions are as follows:

  • Fixed shipping rate: 28.00 euros

For shipments to Denmark, Belgium, the Czech Republic, Luxembourg, the Netherlands, Slovakia, Romania, Slovenia, Sweden, Poland, Hungary, the conditions are as follows:

  • Fixed shipping rate: 33.00 euros

For shipments to Bulgaria, Croatia, Portugal, Finland, Ireland, Estonia, Latvia, Lithuania, the conditions are as follows:

  • Fixed shipping rate: 38.00 euros

For shipments to Switzerland and the United Kingdom, we cannot establish a fixed shipping rate but you can still order what you want. Send us a request to our e-mail address info@luigitega.it with the indication of the items you want to buy (code, item, quantity, preferred form of payment, name and surname, delivery address, telephone number). We will immediately analyze the order and report any transport costs to you.

WE DO NOT SHIP TO: non-EU countries (except Switzerland and the United Kingdom), Cyprus, Greece, Malta, Norway, Spain.

Please note:

    • For substantial purchases, shipping costs do not increase, there is no maximum weight or maximum quantities that cannot be shipped.
    • All express deliveries, regardless of the type of goods ordered, cause an increase in shipping costs. Due to the complexity of the cost calculation, we omit a detailed explanation. However, to take advantage of these services, write to info@luigitega.it.

DELIVERY AREA
The Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS makes deliveries throughout the national territory (Italian), EU countries, Switzerland, the United Kingdom (except: Cyprus, Greece, Malta, Norway, Spain) via affiliated express couriers.

ORDER PROGRESS STATUS
The Company MOLINO IL FATTORE DI TEGA LUIGI & C. SAS provides registered Customers on the Internet with an online tool for viewing the current status of their orders.

PRODUCT UNAVAILABILITY
If the products ordered are temporarily unavailable, the Company MOLINO IL FATTORE DI TEGA LUIGI & C. SASwill promptly inform the Customer, proposing various solutions, without prejudice to the latter’s right to renounce the order.

CANCELLATION OF ORDERS
The Company MOLINO IL FATTORE DI TEGA LUIGI & C. SASmakes available to customers registered on the Internet an online tool for canceling orders placed within 24 hours.

RIGHT OF WITHDRAWAL
Pursuant to the combined provisions of articles. 64 et seq. of the CONSUMER CODE (Legislative Decree 2005/206) and the provisions of the Legislative Decree. 21 February 2014, n. 21, the final consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. This right can no longer be exercised in relation to the categories of goods and services expressly specified in the art. 59 of the Legislative Decree 21 February 2014, n. 21 (by way of example but not limited to the types of products marketed on the SITE that could most likely be subject to this exclusion or art. 59 letter c) supply of goods made to measure or clearly personalized; art. 59 lett. d) supply of goods which risk deteriorating or expiring rapidly; art. 59 lett. e) supply of sealed goods which are not suitable for return for hygienic or health protection reasons and have been opened after delivery; art. 59 letter f) supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods; art. 59 lett. g) supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on fluctuations on the market which cannot be controlled by the professional).

To exercise this right, the customer must send a communication within 14 working days from the date of receipt of the goods. This communication must be sent by email to info@luigitega.it, via the appropriate form or by telephone at +39 0742660015. Once the aforementioned withdrawal communication has been received, customer service will communicate to the customer the instructions on how to return the goods which must arrive at our warehouses within 10 days of authorisation.
The right of withdrawal is however subject to the following conditions:
The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;

  1.  According to law, the shipping costs relating to the return of the goods are the responsibility and on behalf of the customer;
  2. Shipping, until receipt is certified in our warehouse, is under the complete responsibility of the customer;
  3. We are not liable in any way for damage or theft/loss of goods returned by uninsured shipments;
  4. In the event of damage to the goods during transport, the customer will be notified of the incident (within 5 working days of receipt of the goods in their warehouses), to allow him to file a complaint against the courier he has chosen and obtain compensation reimbursement of the value of the property (if insured). In this eventuality, the product will be made available to the customer for its return at the same time canceling the withdrawal request;
  5. The right of withdrawal cannot be exercised in any way with respect to perishable goods whose expiry date is less than or equal to 10 days. The entire amount already paid will be refunded to the customer, within 30 days of the return of the goods, through a cancellation procedure of the amount charged to the Credit Card/Paypal or by bank transfer. In the latter case, it will be the customer’s responsibility to provide the bank details on which to obtain the refund.
    The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where it is ascertained:
  • the lack of the original external/internal packaging;
  • the absence of integral elements of the product;
  • use of the product in such a way as to make it impossible to restore it to the conditions pre-existing upon sale;
  • modifications and/or tampering with the product.

The right of withdrawal cannot be exercised in any way by professionals or operators with a VAT number.
